| | | re: Plant with black berries identification Black Nightshade, Solanum nigrum. The fruits do contain various toxins but ripe berries are much less toxic than green fruits.
If you have young children who are likely to eat them then it may be best to remove, otherwise I wouldn't worry, it's a fairly common weed of disturbed ground.

I've got the same plant in my garden.
I think it might have been brought in with a bag of bird seed or two thats been thrown around the garden!

| | | re: Plant with black berries identification Black Nightshade, a common weed of cultivated areas of gardens, allotments etc. is normally spread by birds. They eat the berries which pass-through the bird and remain fertile.
Not likely to be a constituant of bird-seed.
