| | | County Court Summons After several letters instructing me that a certain Company's records note that a premium of £0.00 is still outstanding (all of which I have ignored) I have now received notification that, in the event of this amount remaining unpaid, they regret to inform me that they will have no altenative but to apply for a County Court Summons for recovery of this debt.
I have to say that I am quite looking forward to my day in Court, preceded by a night in a five star hotel and reimbursement of my daily salary and that of the accomodation.

| | | Re: County Court Summons I fully intend to show up for the day and apply for out of pocket expenses which, as I said, will include accomodation and loss of earnings. Why should I waste time prior to the hearing, and go to the expense of phoning these muppets to tell them of their mistake? It's not some tin pot company but those guys that are supposed to salute you when they fix your car. |

| | | Re: County Court Summons I don't think you'll get the chance for your day in court Boddie as from what you've said they are only threatening to 'apply' to get a county court summons.
You'd expect any judge with even half their marbles would throw the application out... there must be some
You could send them a cheque for £0.00 and then they would have to pay charges for cashing it |

| | | Re: County Court Summons I've been told that the summons will be automatically generated and will only be thrown out on the day when the clerk to the court reviews the cases, by which time I will have booked time off and contacted the national press. |

Boddie .... what a bizarre story. I am sure you can have lots of fun with this. Do let us know the outcome unless you do get sent down and can't get messages out to the outside world .

| | | Re: County Court Summons There is no guarentee the Court will award you costs. More importantley if the Court feels you have acted unreasonabley they can instruct that you pay the companies costs. The Courts time is valuable and it could be argued that you have wasted it as the matter could have be resolved by you contacting the company and informing them of thier errror. Therefore you could end up being penalised

I think I'd take that risk but I fail to see how its my responsibility to inform the RAC, the Clerk to The Courts and The Judges that I owe the Court the princely some of zero simply because they have all neglected to review their papers. Why should I waste my time informing a Company that they have repeatedly (and I mean some dozen times) accused me of owing them money?
I should sue them for harrassment. |

| | | Re: County Court Summons No doubt "the computer" will be to blame. I can guess that there are rounding errors involved and "the computer" actually thinks that you owe 0.56 pence, or something similarly absurd, but of course the software can't display this in your bills.

I paid off the full balance that was asked of me.
Endquote
I'm sure you did Boddie, but the computer may not be able to print you an invoice for 0.56 pence (that's a decimal portion of a penny, just over half a penny) even though it's stored in its little 'brain' and that's where the problem may lie.
