there's nothing illegal about collecting toads as long as you don't harm them or sell them. however, the reason why you don't already have them in your pond may be because it isn't ideal habitat for them. toads will use small garden ponds if there is nothing else available but they prefer larger well established bodies of water for breeding. they also tend to disperse after breeding so you may not see them around the pond much after march/april anyway.
i understand why you would want to 'acquire' some for your garden...they are lovely, but if it were me i'd create the right environment, cross my fingers and wait patiently to see what turns up of it's own accord.

I have toads that live in the cracks in my drive, on top of my hose reel and in the greenhouse, there is currently one wandering in the garden under the pacasandra even one living in a dry flowerpot in my garage.
I water the garden after sunset put the hose away and just wait to see what comes out onto the lawn,Toads are usually first, with one or two Frogs
