I am utterly gob-smacked over this one

this has been widely discussed on talk photography where i'm also a member and the short version is that its the usual scaremongering balderdash from AP

Basically that ruling relates to a very specific set of circumstances where there was already previous history between the plaintiff and defendant , and clear case of intent to plaigarise in the creation of the latter image ...as such it doesnt set any manner of worrying precedent for the rank and file of photographers , and basically smacks of AP not letting the facts stand in the way of a good story

on reading further info I understand the image is a trade icon and the 2nd party was trying to sail as close as possible to infringing upon it to gain trade from the 1st
I did have a gander at the full legislation but my legalese is not up to much
what is rather worrying reading on another forum is the English one is rather short, and loosely worded compared to the American ruling so possibly more open to manipulation
anyway i promise not sue anyone taking hoppers on a neutral plastic background unless they are making more money than me
