You need to see the underside of the hind wing to be able to distinguish between Copper Underwing and Svenssons Copper Underwing. See 'Skinner' and text.
They also have an overlap in times on the wing just to make things doubly difficult!!
I think yours could be Svenssons Copper Underwing going by the markings.
