There is an aspect that just crossed my mind.
In Scotland, courts convict on "Balance of Probability" rather than absolute proof.(no getting off on technicalities here)
In that case this fox would be seen as "guilty" in a Scottish Court.

I'm not quite sure what you mean by this, if anything, standards of proof are surely higher in Scottish criminal courts due to the requirement for corroboration.

I'd suggest at the moment the verdict would be "Not Proven".
