ID for a small yellow flying thing

Found this little fly today, see photo, having a rest in my garden. What was odd was that it was rotating its 2 wings at rest independently.

Only about 4mm long.

Can anyone ID please and why was it moving its wings so?

Looks like a male picture winged-fly, possibly Trypeta zoe based on wing colouration, although end of September is possibly a bit late for that species.

Quite a few diptera do the wing-waggling thing: I presume its to do with attracting a mate. Do you know what plant it was on?

It landed on a non-native foxglove which I am looking forward to seeing flowering next year.

I guess the little fellow was just showing off & passing through ..... and of course we are just going through an Indian Summer, which might allow for the unseasonable appearance.
