Mystery mico fly - predator?

I was out walking with my wife Margaret on a heath when I spotted this very small fly which seemed to have the capacity to extend and retract it's ovipositor /sting. She took this photograph

Have no idea what it is so can anyone please identify it from this very poor image taken in blustery condition and in poor light.

Thats an ovipositor - I can't get the photo to expand but from the patterned wings I would think that somewhere in the Tephritidae might be a good place to start looking.
