Agree, dogs should be kept under close control or on a lead on a NR any time of the year.
Worth noting that this prosecution was largely successful because of the eye witness complaints by bird watchers etc at the time. Though many won't like direct confrontation, taking a photo of the incident from a safe distance and reporting it ASAP to the police/wardens etc will help prevent more of this type of disturbance and lead to more prosecutions.
