They don't really go into rules, the only two I can see are1) that you count only the birds that are actually using the space that you are watching not merely flying over, and 2) the max number seen at any one time. But a kestel hovering or a sparrowhawk flying over on the chance of grabbing one of the birds on your feeder, well they can be counted even if they don't actually land. Also if you had a very early swallow catching insects on the wing over your garden or wherever it was that you were watching ...
