I would say Tufted duck head shape wrong for scaup would also expect back and sides to show hints of gray unlike the brown of this bird.

Definitely a Tufted Duck.

The head is squarish, not the typical rounded shape of Scaup, and their is a visible 'tuft' (though not exactly a prominent one!). The black at thetip of the bill can also be seen to extend along the sides, and as Mike has said, Scaup generally show some grey feathering on the body.
