My understanding is that, for those plants that are not listed on schedule 8 (i.e. those that are not specially protected) an offence is committed if they are
intentionally uprooted by a person who is
not authorised. An authorised person in this instance would be the landowner or occupier or anyone authorised by the landowner/occupier.
