| Re: What a short break... Remember he has only had a notice of intended prosecution at this stage so could still get an offer.
My advice would be to request the following
· Photographic evidence – all evidence they would intend to use in court. If applicable, how far apart the photographs were taken.
· A calibration certificate of the equipment utilised and all serial numbers of said equipment.
· Evidence of the users training and latest attestation on the use of such equipment.
· The index plate of the vehicle used and a history of its ‘markings’. The vehicles have to, by law, be marked sufficiently and are no longer allowed to be stealthy in appearance or obscured in any way.
· The exact location of any camera warning and speed limit reminder signs.
· Communications of proposed mobile camera sites. They have a duty to publicise their activities in newspapers and via radio.
· Details of any sign designs and their respective locations.
· The last recorded site review, in accordance with prominence, visibility and signing - They are no longer allowed to put a van anywhere. It has to be in a location with a 'history'.
Most of these departments expect the good honest citizen to roll over and have their tummy tickled. You should contest this ticket and in may cases they give up.
If you never saw this van they knew exactly what they were doing and therefore it is out of order.
Hope this helps |
